If you are being contacted by a debt collection agency for an unpaid debt, it is very important that you are aware of your rights regarding debt collection. Third party debt collectors are required to abide by specific State and Federal laws. These laws were designed to help protect consumers from inappropriate debt collection activity.

The two primary Federal laws that protect consumers from unethical debt collection tactics is the Fair Debt Collection Practices Act (FDCPA) and the Fair Credit Reporting Act (FCRA). It would be wise to familiarize yourself with these laws and report any violations to your state Attorney General’s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov).

Also, if you are able to prove in court that a debt collector violated the FDCPA, you are entitled to up to $1,000.00 in statutory damages, payment for any actual damages including emotional distress, and payment of your attorney’s fees and costs.
